If you suffered an injury by accident during the course and scope of your employment, you must file a claim with the Industrial Commission of Arizona within one year from the date of injury or you will be forever barred from filing a claim. Not all injuries, however, occur immediately. Some claims occur after months or years of repeated work activities and multiple reinjuries. These types of claims or injuries are known as “gradual onset injuries” and are the most difficult claims to file. Many injured workers use the wrong date of injury when filing a gradual onset workers’ compensation claim which results in their claims being denied.
